The Office of Fossil Energy gives notice of receipt of a joint application filed December 17, 2010, by Freeport LNG Expansion, L.P. and FLNG Liquefaction, LLC  (collectively FLEX), seeking  a long-term multi-contract authorization to export up to the equivalent of 9 million metric tons per annum of domestically produced LNG, up to a total of 225 million metric tons.  Authorization is for a 25 year period commencing on the date of first export, or 5 years from the date the authorization is issued, whichever is sooner. FLEX proposes to export LNG from Quintana Island near Freeport, Texas, to any country with which the United States does not have a free trade agreement  requiring national treatment for trade in natural gas and LNG, which has or in the future develops the capacity to import LNG via ocean-going carrier, and with which is not prohibited by U.S. law or policy. Sabine Pass Liquefaction, LLC - FE Dkt. No. 10-111-LNG
The Office of Fossil Energy gives notice of receipt of an application filed September 7, 2010, by Sabine Pass Liquefaction, LLC (Sabine Pass). Sabine Pass is seeking long-term, multi-contract authorization to export up to 16 million metric tons per annum of liquefied natural gas (LNG) from the Sabine Pass LNG Terminal to any country with which the United States does not have a Free Trade Agreement requiring the national treatment for trade in natural gas and LNG, that has or in the future develops the capacity to import LNG, and with which trade is not prohibited by U.S. law or policy. Sabine Pass requests this authorization for a 20-year term commencing the earlier of the date of first export or five years from the date of issuance of the authorization requested.  Sabine Pass further requests that insofar as the application seeks authorization for exports to member nations of the World Trade Organization (WTO), DOE review the application under section 3(c) of the Natural Gas Act, 15 USC 717b(c).  F.R. Notice Published 10/12/10; 75 FR 62512; comments were due on 12/13/10. On October 21, 2010, DOE/FE issued an opinion and order that the application will be reviewed under section 3(a) of the NGA, and denied Sabine Pass’ request for review under section 3(c) of the NGA.  A Procedural Order was issued on 12/17/10 granting a 15 day comment period in which responses  to the comments and motions received in this docket will be accepted. Responses must be filed within 15 days after the date of this order (January 11, 2011). Opinion and Order 2961 issued May 20, 2011 to Sabine Pass Liquefaction, LLC - FE Dkt. No. 10-111-LNG, Conditionally Granting Long-Term Authoritzation to Export LNG from Sabine Pass LNG Terminal to Non-Free Trade Agreement Nations.
