Sabine Pass Liquefaction, LLC - FE Dkt. No. 10-111-LNG


The Office of Fossil Energy gives notice of receipt of an application filed September 7, 2010, by Sabine Pass Liquefaction, LLC (Sabine Pass). Sabine Pass is seeking long-term, multi-contract authorization to export up to 16 million metric tons per annum of domestically produced liquefied natural gas (LNG) from the Sabine Pass LNG Terminal to any country with which the United States does not have a Free Trade Agreement requiring the national treatment for trade in natural gas and LNG, that has or in the future develops the capacity to import LNG, and with which trade is not prohibited by U.S. law or policy. Sabine Pass requests this authorization for a 20-year term commencing the earlier of the date of first export or five years from the date of issuance of the authorization requested.  Sabine Pass further requests that insofar as the application seeks authorization for exports to member nations of the World Trade Organization (WTO), DOE reviews the application under section 3(c) of the Natural Gas Act, 15 USC 717b(c).  F.R. On October 21, 2010, DOE/FE issued an opinion and order that the application will be reviewed under section 3(a) of the NGA, and denied Sabine Pass’ request for review under section 3(c) of the NGA. 

A Procedural Order was issued on 12/17/10 granting a 15 day comment period in which responses to the comments and motions received in this docket will be accepted. Responses must be filed within 15 days after the date of this order (January 11, 2011).
